Last updated: 11 May 2026These terms govern your use of rapidsafetyfiles.co.za and any safety file you order from us. By placing an order you accept these terms. They sit alongside our Privacy Notice and Refunds & Rework Policy.
Full terms
1. The parties.
“We”, “us”, and Rapid Safety Files mean Business Made Simple Holdings (Pty) Ltd, a company registered in South Africa. “You” means the contractor, business, or individual placing an order. If you place an order on behalf of a business, you warrant that you are authorised to bind that business.
2. What we deliver.
On payment we compile, review, and deliver a site-specific occupational health and safety file aligned to the OHS Act 85 of 1993 and (where applicable) the Construction Regulations 2014. The file includes a written Compliance Rationale Report that cites the legislation behind every included document.
Our delivery target is sixty minutes from successful payment during South African business hours (08:00–17:00 SAST, Monday–Friday, excluding public holidays). Outside those hours we deliver on the next business morning. If we expect to miss the sixty-minute target on a specific order, we notify you in writing.
3. What you provide.
For us to compile a site-specific file you must give us:
- Registered company details and contact information.
- Scope of work, site address, project duration, and headcount.
- Names, ID numbers, qualifications, and signatures of the people you nominate into statutory appointments.
- Any owner- or principal-contractor-specific requirements.
You warrant that the information you provide is accurate and complete and that you are entitled to share the nominated personnel's information for the purpose of compiling your file (see our Privacy Notice).
4. Price and payment.
The standard safety file is R2,000 inclusive of VAT. Add-on items (Tender Pack, additional appointments beyond the included scope, multi-site licensing) are quoted separately and confirmed in writing before charging. Payment is required upfront via the channels listed at checkout. The 60-minute delivery clock starts when payment clears.
5. Licence to use the file.
We grant you a non-exclusive, non-transferable licence to use the compiled file for the specific site, project, and scope identified at order. You may share the file with the principal contractor, the owner, the Department of Employment and Labour, and inspectors as required. You may not resell the file, redistribute it as a template, or use it on a materially different site or scope without ordering a fresh file.
6. Reviews and rework.
Every file is reviewed by OHS professionals with more than 30 years of South African construction safety experience before delivery. If a file we compiled is rejected because of our error (a missing document, a wrong citation, a clerical mistake), we rework it free of charge and refund 50% of the order value as a goodwill payment. 7. Your obligations on site.
A safety file is documentation. It does not, on its own, make a site safe. You remain responsible for implementing the documented controls, training your workers, conducting toolbox talks, keeping the registers current, and complying with every other applicable duty under the OHS Act and the regulations. 8. Limitation of liability.
To the maximum extent permitted by South African law, our total liability for any claim arising out of or in connection with an order is capped at the amount you paid for that order. We are not liable for indirect, special, consequential, or pure-economic losses (including lost profits, lost contracts, or third-party penalties), even if we were advised of the possibility. Nothing in these terms excludes liability that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008.
9. Intellectual property.
We retain copyright in our document templates, the Compliance Rationale Report format, and the underlying compilation logic. The completed file populated with your project-specific information is yours to use within the licence granted in section 5.
10. Termination and suspension.
We may suspend service or refuse a future order if you breach these terms, abuse our staff, attempt fraud, or use the service to misrepresent the safety controls actually in place on a site. You may cancel an order before delivery; see the Refunds & Rework Policy for cancellation terms.
11. Governing law and dispute resolution.
These terms are governed by the laws of the Republic of South Africa. The Western Cape Division of the High Court has non-exclusive jurisdiction. Before issuing summons either party must give the other 14 days' written notice of the dispute and attempt to resolve it in good faith. Consumer-protection rights under the CPA remain available.
12. Changes.
We may update these terms. The version that applies to your order is the one in force on the day you placed the order. Material changes for active customers are communicated by email.
